All user-submitted Content is processed by AI-powered moderation (using Anthropic Claude) to assess accuracy, appropriateness, and safety. Content may be automatically approved, flagged for manual review, or rejected. We reserve the right to remove any Content that violates these Terms, without prior notice.

Refunds are handled by Apple or Google in accordance with their respective refund policies. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

8. Intellectual Property

The Service, including its design, layout, graphics, text, software, mascot character “Bubba”, app icons, and all other proprietary content, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited licence in Section 4.

9. Location Services

The Service uses your device’s location to provide core functionality (finding nearby parent rooms). Location data is only accessed with your permission and only while you are using the App. You can control location permissions through your device settings. Disabling location services may limit certain features of the Service.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

We may modify these Terms from time to time. For material changes, we will provide at least 30 days’ notice via in-app notification or email before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the Service and may request deletion of your account.

You may stop using the Service and delete your account at any time through the App (Settings > Delete Account) or by contacting us.

Upon termination, your licence to use the Service ends. Content you have submitted may remain on the Service in anonymised form. Any active subscription will continue until the end of the current billing period but will not renew. Sections 5.1, 8, 10, 11, 15, and 16 survive termination.

15. Governing Law and Dispute Resolution

15.1 Governing law

These Terms are governed by the laws of Queensland, Australia. You agree to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.

Nothing in these Terms limits your right to bring proceedings in any court of competent jurisdiction in Australia.

15.2 Dispute resolution

If a dispute arises in connection with these Terms, the parties agree to follow this process:

  1. Good faith negotiation: The parties will attempt to resolve the dispute through good faith negotiation for a period of 30 days from written notice of the dispute
  2. Mediation: If negotiation is unsuccessful, the parties will submit the dispute to mediation administered by the Resolution Institute (or another agreed mediator) before commencing legal proceedings
  3. Court proceedings: If mediation is unsuccessful, either party may commence court proceedings

Nothing in this clause prevents either party from seeking urgent injunctive or interlocutory relief from a court.

16. General Provisions

16.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it will be severed. The remaining provisions will continue in full force and effect.

16.2 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
